Carlos L. de Zayas has, since 1975, concentrated his practice on complex commercial litigation, creditors' rights and bankruptcy. His experience includes insurance insolvency, construction litigation, employment litigation, and appeals. He has tried numerous jury and bench trials in state and federal courts, and has been appellate counsel in many reported appellate decisions in the commercial litigation, insolvency, creditors' rights and bankruptcy areas.
Carlos has successfully represented commercial banks, insurance carriers, construction companies, real estate developers, the licensee/distributor for Latin America of a major Japanese electronics manufacturer, a charter airline, a major international hotel group, the State of Florida Department of Financial Services, the Florida Workers' Compensation Insurance Guaranty Association, an interstate dealer of heavy trucks, and its related finance companies. He has previously served as a Chapter 7 bankruptcy trustee and as counsel to debtors, creditors and official committees in Chapter 11 cases.
Mr. de Zayas has substantial experience representing both commercial debtors and institutional creditors in connection with commercial claims and collections; in protection of, and realization on, various types of collateral; in enforcement of judgments; in commercial foreclosure of mortgages and other security interests; in contract litigation; in preference and fraudulent conveyance actions, and in Chapter 11 bankruptcy reorganizations. This varied experience with "both sides" of typical commercial litigation disputes benefits the Firm's clients in developing successful and efficient strategies for the protection of their interests.
Carlos has been a frequent speaker in continuing legal education seminars on creditors' rights and bankruptcy law. He has served on the Business Litigation and U.C.C./Bankruptcy Law Committees of the Florida Bar's Business Law Section, and is an active member of the Bankruptcy Bar Association of the Southern District of Florida.
Carlos received his Bachelor of Arts degree in economics from Rutgers University, and his Juris Doctorate from the Rutgers University School of Law. He is admitted to practice before the Supreme Court of the United States, the United States Court of Appeals of the Eleventh Circuit, the United States District and Bankruptcy Courts of the Northern, Southern and Middle Districts of Florida, the District of Colorado, and the District of New Jersey. He regularly practices, in association with local counsel, in federal and bankruptcy courts throughout the United States.
Mr. de Zayas has been married to Carolyn Simmons, an active commercial real property appraiser, for over 20 years. They have one daughter, Veronica, who attends Dartmouth College. The de Zayases are active members of the Coconut Grove Sailing Club, where Carlos has served on the Board of Directors. Carlos is also a licensed radio amateur and certified Scuba Diver.
